Mogire Mogaka on Friday filed an appeal before the Judicial Service Commission over deputy Chief Justice Mwilu's transactions with collapsed Imperial Bank and funds received from a questionable Ugandan firm.
He claimed the transactions have rendered her unsuitable for any public office.
Mr Mogaka claims that Justice Mwilu infringed laws of the Constitution of Kenya that require public officers to shun shady practices, whether in their individual or official capacity.
“The DCJ got an unsecured loan of Sh80 million. It is now clear why Imperial Bank collapsed and many Kenyans are suffering.
Justice Mwilu is not fit to be the Deputy Chief Justice. She has clearly failed in the integrity test,” Mr Mogaka says.
He additionally claimed that the Justice Mwilu receiving interest-free loans from Imperial Bank depicts that she may have used her powers to benefit.
Mr Mogaka had earlier in September initiated a another case on CJ Maraga, over his failure to swear in new JSC commissioners.
